Terms of Service

1. Acceptance of Terms

By accessing or using MidGenAI, you confirm that you have read, understood, and agreed to these Terms of Service and our Privacy Policy. If you use MidGenAI on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to use MidGenAI. If you are under the age of legal majority, you may use MidGenAI only with the permission and supervision of a parent or legal guardian.

You must not use MidGenAI if applicable law prohibits you from receiving or using the services.

3. User Accounts

Some MidGenAI features require an account. You agree to provide accurate information and to keep your account information current.

You are responsible for maintaining the security of your account and for activity performed through it. You must notify us if you believe your account has been accessed or used without authorization.

You may not sell, transfer, share, or provide access to your account in a way that violates these Terms or creates a security risk.

4. License to Use MidGenAI

Unless otherwise stated, MidGenAI owns or licenses the intellectual property rights in its website, branding, interface, logos, software, design, and original content.

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use MidGenAI in accordance with these Terms.

This license does not allow you to copy, resell, redistribute, reverse engineer, scrape, exploit, or create a competing service from MidGenAI except where applicable law expressly permits it.

5. User Content

“User Content” includes prompts, text, source images, reference images, photographs, videos, audio, documents, instructions, and other material that you upload, submit, or transmit through MidGenAI.

You retain any ownership rights you have in your User Content. You are solely responsible for your User Content and for ensuring that you have all permissions, licenses, and legal rights necessary to upload and process it.

You must not upload images or other material that violates copyright, trademark, privacy, publicity, confidentiality, contractual, or other rights. If your content depicts another person, you are responsible for obtaining any consent required to upload, edit, or generate content using that person's image or likeness.

By submitting User Content, you grant MidGenAI and the service providers used to operate MidGenAI a limited, worldwide, royalty-free license to host, transmit, reproduce, modify, and process that content only as reasonably necessary to provide, secure, maintain, and improve the requested service.

This license ends when the content is no longer reasonably required to provide the service, subject to temporary caches, backups, security records, legal obligations, and third-party provider retention practices.

6. Image-to-Image and Uploaded Images

The Image-to-Image tool allows you to upload a source or reference image and use artificial intelligence to create a new or modified output.

You represent that you own the uploaded image or have permission to use, modify, and process it. You must not use Image-to-Image to impersonate, deceive, harass, or violate the privacy or rights of another person.

Uploaded images may be transmitted to MidGenAI's infrastructure and third-party AI providers as necessary to process your request. Outputs may preserve or reproduce elements of the source image and may contain unexpected, inaccurate, or undesirable elements.

7. AI-Generated Output

“Output” means images, edited images, audio, video, text, or other material generated or processed through MidGenAI.

Artificial intelligence may produce inaccurate, incomplete, misleading, biased, offensive, or unexpected results. Output may resemble content generated for other users or existing third-party works.

You are responsible for reviewing Output before using, publishing, distributing, selling, or relying on it. You must ensure that your use complies with applicable laws and does not violate intellectual property, privacy, publicity, contractual, or other rights.

MidGenAI does not guarantee that Output is unique, original, accurate, lawful, copyrightable, suitable for a particular purpose, or free from third-party claims.

8. Commercial and Non-Commercial Use

Subject to these Terms, applicable law, third-party rights, and any restrictions imposed by an applicable AI provider, MidGenAI allows Output to be used for personal and commercial purposes.

• AI Image Generator and Image-to-Image: Output may be used in websites, social media, marketing, advertisements, games, applications, design work, and client projects.
• Text-to-Speech: Generated audio may be used in videos, podcasts, games, applications, presentations, advertisements, and other creative projects.
• Text-to-Video: Generated videos may be used for marketing, education, social media, presentations, entertainment, and business projects.
• Background Remover: Processed images may be used for personal or commercial purposes if you have the necessary rights to the original images.

MidGenAI does not claim ownership of your Output. To the extent permitted by applicable law, you may use the Output subject to these Terms and the rights of others.

Nothing in these Terms guarantees that you will obtain copyright, exclusive ownership, or enforceable intellectual property rights in AI-generated Output.

9. Prohibited Uses

You must not use MidGenAI to create, upload, process, distribute, or promote content or activities that:

• Are illegal, fraudulent, deceptive, defamatory, or abusive.
• Infringe copyright, trademark, privacy, publicity, confidentiality, or other rights.
• Exploit, sexualize, or endanger children or other vulnerable persons.
• Contain non-consensual intimate imagery or sexually explicit deepfakes.
• Impersonate another person or misrepresent AI content as authentic for deceptive or harmful purposes.
• Promote hatred, harassment, discrimination, violence, terrorism, or criminal conduct.
• Include malware, malicious code, phishing, or attempts to gain unauthorized access.
• Attempt to bypass safety systems, usage restrictions, authentication, rate limits, or security measures.
• Scrape, reverse engineer, overload, disrupt, or exploit MidGenAI or its providers.
• Violate applicable laws, regulations, sanctions, or court orders.

10. Content Moderation and Enforcement

We may use automated or manual safeguards to detect abuse, prohibited content, security threats, or violations of these Terms.

We may restrict content, suspend features, limit access, or terminate accounts when reasonably necessary to protect users, comply with law, enforce these Terms, or preserve the security and operation of MidGenAI.

We are not obligated to monitor all User Content or Output and cannot guarantee that all prohibited content will be detected.

11. Third-Party Services

MidGenAI relies on third-party infrastructure, authentication, storage, analytics, content moderation, and AI providers. Your content and technical information may be transmitted to these providers when necessary to deliver the requested service.

Third-party services are operated independently and may be governed by their own terms, privacy policies, availability commitments, and usage restrictions.

MidGenAI does not control and is not responsible for changes, outages, errors, security incidents, or retention practices of independent third-party services, except to the extent required by applicable law.

12. Account Deletion

You may request account deletion through the MidGenAI Settings page. In production, account deletion is scheduled after a 14-day grace period.

You may cancel the deletion request through Settings at any time before the grace period expires. After the deletion process has completed, your account and associated content may not be recoverable.

The deletion process is designed to remove your MidGenAI profile, Firebase authentication account, posts, stored images, likes, and follow relationships.

Limited records may remain temporarily in backups, caches, security logs, fraud-prevention systems, or third-party provider systems. We may also retain information where reasonably necessary to comply with law, resolve disputes, prevent abuse, or enforce these Terms.

13. Service Availability and Changes

MidGenAI is provided on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee uninterrupted, secure, error-free, or permanent availability of any feature.

We may add, modify, suspend, restrict, or discontinue features at any time. AI models and third-party services may also change their functionality, availability, pricing, or restrictions without notice.

14. Disclaimer of Warranties

To the maximum extent permitted by applicable law, MidGenAI disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, and availability.

We do not warrant that MidGenAI or its Output will meet your requirements or that defects, errors, or harmful components will always be detected or corrected.

15. Limitation of Liability

To the maximum extent permitted by applicable law, MidGenAI and its owners, operators, affiliates, and service providers shall not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, or for lost profits, lost data, business interruption, loss of goodwill, or the cost of substitute services arising from your use of MidGenAI.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

16. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless MidGenAI and its owners, operators, affiliates, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from your User Content, your use of Output, your violation of these Terms, or your violation of another person's rights.

17. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be published on this page with a revised “Last Updated” date.

Where required, we may provide additional notice of material changes. Your continued use of MidGenAI after updated Terms become effective means that you accept the revised Terms.

18. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to applicable consumer-protection laws, disputes arising from these Terms or MidGenAI shall be submitted to the competent courts of India.
